These are the terms for using RealSpace — the app, the website, and everything they connect to. By creating an account, you agree to them.
Read this part first
RealSpace does not sell, transfer, or convey any legal interest in real property. "Claiming a square" is a feature of this app and nothing more: it records, in our database, that your RealSpace account is associated with a 12 m² grid cell at a set of real-world coordinates. It does not give you any ownership, lease, easement, right of access, or other legal interest in the physical land or any structure at that location. The actual owner of that land has no relationship with RealSpace, has not consented to anything, and is not affected by anything you do in this app. Never treat a RealSpace claim as a real-estate transaction, a survey, or a legal record of any kind.
01Accounts
You need an account to claim squares, upload content, or interact socially — browsing the public map doesn't require one. You must be at least 13 years old to create an account. You're responsible for keeping your password confidential and for everything that happens under your account. Tell us immediately if you suspect unauthorized access.
02Claimed squares aren't real property
We meant it above, and we mean it here too: nothing in RealSpace transfers any interest in real property. A "square" is a 12 m² cell in our own fixed global grid, priced using public data about the neighborhood it's in — it is not a parcel of record, not a survey, and not recognized by any government or title system. Claiming a square does not give you any right to enter, use, modify, or be present on the physical land it corresponds to; whatever rights exist there belong entirely to whoever actually owns or lawfully occupies that property under real property law, unaffected by this app. If you place a 3D model "on" a square, that model exists only in augmented-reality overlay and our own records — never on the physical property itself.
If a square you've claimed corresponds to land you don't own, control, or have permission to be near, you're still bound by ordinary trespassing and property law when you're physically there — RealSpace claiming a square for you creates no exception to that.
03RealSpace Tokens
Draft wording, to be reviewed by counsel before RealSpace takes real payments — the refund terms in particular.
RealSpace Tokens are a virtual, in-app currency you spend to claim squares, to keep things you've kept privately for good, to get models from the store, and to unlock storage and features. They are:
Not money, currency, or a financial instrument of any kind, and not a security, commodity, or investment.
Valid only within RealSpace, with no cash value outside it, and no guaranteed exchange rate.
Non-transferable. Tokens stay on the account that bought them. They can't be given away, sold, or moved to another account.
Without an expiry date. Tokens you've been credited stay on your account until you spend them or delete the account.
One balance everywhere. Tokens bought in the app and tokens bought on the website go to the same balance, and you can spend either in either place.
Where you can buy them
In the RealSpace app, tokens are sold through Apple's or Google's in-app purchase systems, and those purchases are subject to Apple's or Google's own terms and refund policies as well as these. On the RealSpace website, tokens are sold by card, as a one-time charge processed by Stripe.
Prices and the number of tokens in a pack are set separately for the two, so the same pack may not credit the same number of tokens in both places. Website purchases currently include a bonus: the same pack, at the same price, credits a set percentage more tokens than it does in the app. Whatever a pack credits is shown before you pay. Token purchases are available in the United States only.
Refunds, and what a refund takes back
Refunding an in-app purchase is Apple's or Google's decision, not ours. They take the payment, they hold the refund policy, and they tell us afterwards what they decided; we follow it. Ask the store. A card purchase made on the website is ours to refund, where the law requires it and otherwise at our discretion.
However a purchase is refunded, the tokens it credited are taken back — including any website bonus that came with them. If you've already spent those tokens, this can leave your balance below zero; you can't spend again until it's back above zero. Squares you claimed stay claimed, and anything you unlocked stays unlocked — what's taken back is the tokens, not what you did with them.
A card chargeback or payment dispute is treated the same way from the moment your bank takes the money back, which is usually as soon as the dispute is opened. If your bank only queries the payment without taking anything back, nothing happens to your tokens. If the money is later returned to us, the tokens go back.
Repeated refunds can stop you buying more tokens. Refunds and lost disputes are counted across the app and the website together, and after most of a purchase has come back to you a small number of times on one account, we may decline further token purchases on that account in both places. Contact us if you think that's wrong.
We may change token prices, the website bonus, or what tokens can be spent on going forward. We won't retroactively take away tokens you've already been credited, except as described above when the purchase that credited them is refunded.
04Storage plans and leases

Two things on RealSpace are monthly subscriptions: storage plans, which add room for your models and sounds on top of your free allowance, and leases, which give you every square in a leasable space for as long as the lease is paid. Storage plans are sold in two places — in the app, through the App Store or Google Play, and on the website, by card — and a plan bought in the app is covered by Storage plans bought in the app below wherever this section says otherwise. A lease is an in-app space, not a tenancy: like a claimed square, it gives you no interest in the real place and no right to go there — see Section 2. While a lease is current it also includes RealSpace's Pro features.
Automatic renewal
A storage plan or lease bought on the website renews automatically every month, and we charge the card you subscribed with at the start of each month, until you cancel. The monthly price is shown before you subscribe and again on the payment page. It stays the price of that subscription for as long as it runs: if we change our prices, the change applies to new subscriptions, not to yours. If you switch to a different storage plan, the difference for the rest of the current month is added to, or taken off, your next bill.
Cancelling
You can cancel at any time, online, from your profile page under Manage billing. Cancelling stops all future charges. What you've paid for runs to the end of the current month, and you can change your mind and keep the subscription at any point before then.
When a subscription ends
Storage plan: your storage goes back to your free allowance plus anything you bought with tokens. Nothing you've uploaded is deleted, but you can't upload more until you're back under your limit.
Lease: the space's squares are released and it becomes available to others. What you placed there is hidden, not deleted, and comes back as it was if you lease the same space again within 90 days; after that, we may delete it.
If a payment fails
We'll try the payment again over the following days, and you can update your card under Manage billing. A storage plan keeps its extra storage while we retry, and ends as above if the payment still can't be collected once the retries are over. A lease's content stays visible for 7 days after a payment fails; if it hasn't been paid by then, the lease ends as above.
Refunds
Subscription payments aren't refundable, including for part of a month, except where the law requires it. If we end your storage plan or lease early for any reason other than a breach of these terms, we'll refund the unused part of the current month.
Offers
We may offer you a lease at a price agreed with you. An offer is held for you until the date shown on your profile page; the agreed price is that lease's monthly price, and everything else in this section applies to it the same way.
Storage plans bought in the app
In the app, storage plans are sold as auto-renewing monthly subscriptions through the App Store or Google Play, and those purchases are subject to Apple's or Google's own terms as well as these. The price shown is the store's, for one month.
Payment and renewal: Apple or Google charges your Apple ID or Google account when you confirm, and again at the start of every month, until you cancel. On the App Store a plan renews unless it's cancelled at least 24 hours before the end of the current month.
Managing and cancelling: in your App Store or Google Play account's subscriptions — the app's Plans section has a Manage button that opens it. Cancelling stops future charges; what you've paid for runs to the end of the month. Changing to a bigger or smaller plan is done by the store, on the store's terms for proration.
Refunds of an in-app plan are Apple's or Google's decision, not ours; if a plan is refunded, the extra storage it gave ends straight away.
If a renewal payment fails, your plan keeps its storage for as long as the store gives you a grace period, and ends as above if the store stops retrying.
Restore purchases in the Plans section tells us about a plan your store account has, for example after reinstalling the app. A plan belongs to the RealSpace account that bought it.
Storage from a plan bought in the app and from one bought on the website adds up, if you have both — but they are separate subscriptions, and each has to be cancelled where it was bought.
Deleting your account
Deleting your account cancels every storage plan and lease bought on the website straight away, with no further charges and no refund for the rest of the current month. It can't cancel a plan bought in the app: that is billed by Apple or Google, so cancel it in your store account first, or it will go on being charged. How to delete your account sets out the rest of what deleting does.
How payments are handled
On the website, storage plans and leases are sold by card and processed by Stripe. Your card details go directly to Stripe; RealSpace never sees or stores them. Prices are in US dollars, and these subscriptions are available in the United States only. Tokens are sold differently, in two places, and are covered in Section 3.
05Your content
You keep ownership of the 3D models, comments, and other content you upload or post. By posting it, you grant RealSpace a worldwide, non-exclusive, royalty-free license to host, store, display, and distribute it as part of operating the app — which, given how the product works, includes showing your placed models and public comments to other users who encounter your claimed squares. This license ends when you delete the content or your account, except for copies already reasonably necessary for backups or legal compliance.
You're responsible for what you upload. Don't upload anything you don't have the rights to, or anything illegal, infringing, or that violates someone else's rights.
Models in the store
The store offers 3D models: RealSpace's own, and ones other members have shared. Getting one — free, or for tokens — gives you a personal, non-exclusive, non-transferable licence to use it inside RealSpace: to try it, keep it privately and place it on your squares. It doesn't make it yours to download for use elsewhere, to sell, or to share outside RealSpace. Tokens spent on a model aren't refundable, except where the law requires it.
A model you have stays yours to use after it stops being offered in the store. If we remove a model after a report, or because it breaks these terms, it's removed from everyone who had it, including where it was placed.
Sharing your own models in the store
You can share a model you've uploaded in the store, from RealSpace Studio, for free. Nobody pays for a shared model, and you don't earn anything from it.
Your rights: by sharing a model you confirm that you made it, or have the right to share it this way. Don't share models taken from games, films, other apps or paid packs, or anything showing someone else's characters, brands or logos.
The licence you give: you keep ownership. You give RealSpace and every member a free, worldwide, non-exclusive, perpetual licence to use the model inside RealSpace as described above, and RealSpace the right to host, copy, display and distribute it for that. Unlike the rest of your content, this licence doesn't end when you stop sharing the model or delete your account: people who already have it keep it.
Review: every shared model is reviewed before anyone else can see it — by an automated reviewer (an AI model) that looks at pictures of it, the images and names inside the file, and what you wrote about it, and by people when that isn't enough. We can decline a model, and remove one at any time. If the automated reviewer turns yours down, you can ask for a person to look at it.
Stopping: you can stop showing a model in the store at any time. If you delete your account, your shared models leave the store and are credited to "a former member" for anyone who already has them.
Everything else in these terms applies to shared models too, including Section 6 and Section 7.
06Copyright & DMCA
If you believe content on RealSpace infringes your copyright, send a notice to dmca@realspacemobile.com including: (1) a description of the copyrighted work, (2) the specific content and its location in the app, (3) your contact information, (4) a statement that you have a good-faith belief the use is unauthorized, and (5) a statement, under penalty of perjury, that the notice is accurate and you're authorized to act on the copyright owner's behalf. We'll remove or disable access to infringing content and may terminate accounts of repeat infringers.
Designated DMCA agent registration is pending — required with the U.S. Copyright Office before this process is enforceable, tracked separately.
07Acceptable use
Don't use RealSpace to:
Upload malware, or content that's illegal, harassing, hateful, sexually explicit involving minors, or that infringes someone's intellectual property or privacy.
Attempt to claim squares, spend tokens, or access accounts through automation, exploits, or anything other than the app's intended flows.
Interfere with the app's operation, security, or other users' use of it.
Impersonate another person or misrepresent your affiliation with anyone.
Where a model is placed is a rule of its own, because a model can break nothing on this list and still be in the wrong place — see Section 8.
We moderate reported content and may remove it or act on accounts that violate these terms — see our in-app reporting tools.
08Where you can place things
A model you place is anchored to a real location, and some real locations are the wrong place for it whatever the model is. This list is about what you place for everyone to see; what you keep privately is covered under Keeping things privately below. Don't place content at, and don't claim a square in order to place content at:
Schools, nurseries, playgrounds, and anywhere else the people who will find it are children.
Hospitals, clinics, care homes, and the entrances emergency services use.
Places of worship, cemeteries, memorials, and the sites of a tragedy or an atrocity.
Private homes, their gardens and their driveways — including, and especially, aimed at the people who live in one. (Keeping something privately at your own home is different; see below.)
Refuges, shelters, and any other address that is kept quiet for the safety of the people inside it.
Military sites, border crossings, the secure areas of airports, and anywhere else the authority responsible for the place restricts recording or gathering.
Anywhere that standing still and looking at a phone is dangerous or in the way — a roadway, a level crossing, a building site, a fire exit. See Section 9.
This is a rule about the pairing, not about the model. The same model is usually fine one street over, which is why it is worth saying where rather than what: a sculpture nobody would look twice at in a park is a different object outside a hospice.
Claiming a square on its own puts nothing on the ground — a claim is a coordinate in our app and gives you no rights at the real place (Section 2). What people actually encounter is the model placed there, and that is what this section is about and what we can act on.
How a report about a place is handled
We have no automatic way to know what stands at a given set of coordinates, and we would rather say so than imply a filter we don't have. This rule is enforced after the fact, by people, and it starts with a report.
Any model can be reported from inside the app, and "Wrong place for it" is one of the reasons the report form offers — it exists so that this kind of report doesn't arrive filed as "something else" and get read as a complaint about the model, which is the one part that isn't the problem. The report goes to a moderator with the reason, the square, and anything the reporter wrote. Where it is matters to that decision: a report at a school is read before a report at a car park.
If we agree with the report, the model is hidden — it stops being visible at that location, to everyone. If we don't, the report is dismissed. Either way the report itself is kept as a record of what was raised and what we decided. Placing content at these locations, and doing it repeatedly in particular, is a reason to suspend or terminate an account under Section 10.
A report is not a takedown and doesn't remove anything by itself; it puts the thing in front of a person. Nothing is told to the person who was reported about who reported them.
Keeping things privately
As well as placing things for everyone, you can keep a model privately. It stands exactly where you left it, and only you and the people in one of your private places can see it; nobody else is shown it, on a map or through the camera. Because of that, the rule above about private homes doesn't apply to what you keep privately at a home you live in, or at a home whose occupants have agreed to it — keeping a model in your own garden for your own family is what this is for. The other places on that list are still off limits, and everything else in these terms applies to private content too, including Section 7.
People join a place with a code you send them. Only send codes to people you know: a place is for sharing with people you choose, not a way to show things to strangers. Anyone in a place can report something kept in it, and the report is read by a moderator like any other — which means that when something private is reported, we can see it. If we agree with the report, it is hidden from everyone in the place.
Something kept privately for free stops showing after a set number of days — the app says how many before you keep it — and is deleted a short while after that, unless you keep it for good, which costs tokens (Section 3). If you leave a place, or its owner removes you, what you kept there goes with you. If the person who made a place deletes it, everything kept in it is deleted, for everyone in it.
09Physical safety
RealSpace is an augmented-reality app that asks you to walk around while looking at your phone. Stay aware of your surroundings — traffic, uneven ground, other people, and property boundaries — at all times. Don't use RealSpace while driving. Don't trespass on private property to reach a square; see Section 2. You're solely responsible for your own safety and conduct while using the app in the physical world.
10Suspension & termination
You can delete your account at any time from your account page — see How to delete your account for the steps, and our Privacy Policy for exactly what that does to your data. We may suspend or terminate accounts that violate these terms, with notice where reasonably possible. If your account is deleted (by you or by us), squares you claimed are released back into the unclaimed pool for someone else to claim, any storage plan or lease ends with it (see Section 4), and your uploaded content is removed — this is permanent and can't be undone.
11Disclaimers
RealSpace is provided "as is," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We don't warrant that the app will be uninterrupted, error-free, or secure, or that square valuations reflect any real market price.
12Limitation of liability
To the maximum extent permitted by law, RealSpace and its operators aren't liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising from your use of the app — including anything that happens to you or your property while physically using it in AR. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim arose, or $100, whichever is greater.
13Governing law
Governing-law and dispute-resolution jurisdiction to be finalized with counsel before launch — placeholder pending that review.
14Changes to these terms
We may update these terms; if we make a material change, we'll update the date above and, where required, notify you directly. Continuing to use RealSpace after a change means you accept the updated terms.
